The Competition Act

The Competition Act, 2002 (hereinafter referred to as ‘the Act’) follows the philosophy of modern competition laws and aims at fostering competition in the Indian markets and also at protecting Indian markets against anti-competitive practices by enterprises. The Act prohibits the following activities like anticompetitive agreements, abuse of dominant position by enterprises, and imposes strict penalties on their violation and also regulates combinations (mergers, amalgamations and acquisitions) with a view that there will be no adverse effect on competition in India.

The new enterprises while entering into the relevant market faces barriers which is a major restraint on the dynamics of completion.

When a dominant enterprise in the relevant market tries to control an infrastructure or a facility that is necessary for accessing the market and misuses it also which is neither easily producible at a reasonable cost in the short term nor interchangeable with any other such type of products/services, the enterprise may not without sound justification refuse to share it with its competitors at reasonable cost.

This is known as the essential facility doctrine (EFD).
